Osage County Recording InformationDocument Formatting RequirementsDocuments are usually recorded on the day they are received at the Register of Deeds. First, the document is evaluated on the basis of completeness and compliance with state statutes. Second, it is scanned for obvious errors. Third, the proper fees are assessed and the document is filed after the fees have been paid. After these steps are completed, the document is recorded. When the indexing is completed, the document is reproduced digitally and as a hard copy. The original documents are then returned to the owner.To ensure that this process goes smoothly, documents should adhere to the following guidelines:• Original documents only can be recorded—do not send copies.• Documents should be submitted on white 8.5×11 inch paper or 8.5×14 inch paper. Paper should be standard copy weight (20 pound).• Printing should be single sided only, with a font size of 10 point in Times New Roman black ink.• Signatures should be in dark black or blue ink. Names should be printed, typed, or stamped underneath all signatures.• The first page should have a top margin of 3 inches. All other margins should be a minimum of 1 inch.• Documents should be properly signed, notarized, and acknowledged.• If the document includes a legal description, make sure it is complete and compatible with all initial recordings.• All schedules and exhibits within the document should be clearly identified.• Documents should be properly titled, dated, and executed.• Include the name and address of the preparer of the document, as well as a return address so that the document can be returned to the appropriate party.• Deeds must be accompanied by a Real Estate Questionnaire or show a K.S.A. exemption number on the face of the deed. A Mortgage Registration Fee Affidavit is required to claim an exemption.Form of warranty deed:Any conveyance of lands, worded in substance as follows: A.B. conveys and warrants to C.D. (here describe the premises), for the sum of (here insert the consideration), the said conveyance being dated, duly signed and acknowledged by the grantor, shall be deemed and held a conveyance in fee simple to the grantee, his or her heirs and assigns, with covenants from the grantor, for himself or herself and his or her heirs and personal representatives, that the grantor is lawfully seized of the premises, has good right to convey the same and guarantees the quiet possession thereof, that the same are free from all encumbrances, and the grantor will warrant and defend the same against all lawful claims.RECORDING FEESTo record a deed, mortgage, or other instrument of writing, the fee is $8 for the first page (not to exceed 8.5×14 inches), and $4 for each additional page. If sufficient room for recording information is not provided on the first page, an additional page will be added to the document.There is a $5 filing fee for mortgage assignments and releases for each book and page being assigned or released, plus $2 per page being filed.A Mortgage Registration fee of .26% of the principal debt or obligation which is secured by such mortgage is collected on all mortgages, unless exempt.If names are not printed, typed, or stamped underneath signatures, a $1 fee will be collected.

$1.00 — Certificate, certifying any instrument of record, plus the photocopy fees stated below

$2.00 — Fax Copies per page. Photocopies $1.00 for the first page and $.50 for letter size paper and $.75 for legal size paper for each second page and each additional page or fraction thereof. Plus, have the right to charge for postage. E-Mail Copies $1.00 for the first page and $.50 for each additional page.

$25.00 — Execution Fee for Passport.

$1.00 — If names not printed or typed under signatures.

All fees shall be due and payable before the register of deeds shall be required to do the work.

If sufficient space is not provided for the necessary recording information and certification on a document, such recording information shall be placed on an added sheet and such sheet shall be counted an additional page.

A portion of the following fee schedule is established by Kansas Statutes; and a portion by the Osage County Commissioners.

$8.00 — For recording deeds, mortgages, or other instruments of writing, for first page (not to exceed legal size page 8 1/2″ x 14″, includes technology fee).
$4.00 — For second page and each additional page or fraction thereof (includes technology fee).
$5.00 — The filing fee for mortgage assignment & releases for each book and page being assigned/released plus $2.00 per page being filed. (Not to exceed Legal Size 8 1/2″ x 14″)

$46.00 — State Tax Lien Release

Mortgage Registration Fee
of .26% of the principal debt or obligation which is secured by such mortgage, collected on all mortgages. Except on exempt mortgages, see K.S.A 79-3102 for the exemptions.
